JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 The petitioner apprehends his arrest in connection with Hilsa P.S.Case No. 355 of 2017 registered under Sections 365 and 366 of the Indian penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

Allegation against the petitioner is that marriage of the petitioner was fixed with the daughter of the informant and thereafter ring ceremony was also performed. It is alleged that petitioner has kidnapped the daughter of the informant. Submission of learned counsel for the petitioner is that whole case is false and concocted and girl has eloped with some other boy and petitioner has falsely been implicated. He submits that in a compromise petition, informant has admitted that the girl has fled away with some other boy and considering the same, one co-accused has been granted privilege of anticipatory bail by this Court vide order dated 17.07.2018 passed in

Patna High Court Cr.Misc. No.1452 of 2019(2) dt.22-01-2019 2/2 Cr.Misc. No. 41409 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Hilsa at Nalanda in connection with Hilsa P.S. Case No. 355 of 2017; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
