JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-12-2018 The grievance of the petitioner in the instant writ petition is grant of benefit of merger of 50% DA in the basic pay in the matter of fixation of pension and its consequential benefits.

Learned counsel for the petitioner submits that issue raised in the present writ petition is no more res integra. It has been decided by this Court in CWJC No. 3050 of 2009 (Dr. Baleshwar Ojha Vs. The State of Bihar & Ors.) vide order dated 6.3.2009.

In view of the above, the writ petition is disposed of with a direction to the respondents to grant similar benefits to this petitioner which was granted to Dr. Baleshwar Ojha, petitioner of CWJC No. 3050 of 2009. Necessary corrective
