The petitioner seeks bail in connection with Rajpur P. S. Case No.140 of 2021, instituted for the offences under Sections 30(a)(c)(d)(f), 33 and 36 of the Excise Act, 2018. The learned counsel for the petitioner submits that the petitioner is in custody since 03.10.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 1015 litre of liquor from a pick-up van and 1238 bottles of country-made liquor from a place near the pick-up van apart from 2000 empty bottles etc. The learned counsel for the petitioner submits that petitioner was arrested from the spot. The learned counsel

Patna High Court CR. MISC. No.72610 of 2021(2) dt.02-03-2022 2/2 submits that the real culprits after managing the police fled away and the petitioner, who was a passer-by came to be implicated.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cumSpecial Judge, Excise, Rohtas in connection with Rajpur P. S. Case No.140 of 2021.

The application stands allowed.
