JUSTICE RAKESH KUMAR ORAL ORDER 25-07-2016 Heard Sri Raj Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Pothia P.S. Case no.218 of 2015 registered for the offence under Sections 379, 414 of the Indian Penal Code, has prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioner that it was alleged that huge quantity of electric wire was found on the commercial vehicle of the petitioner. He submits that the vehicle was being run by his driver and Khalasi and it was not within the knowledge of the petitioner. He further submits that during investigation also save and except suspicion as well as the fact that the petitioner is owner of the said vehicle, there is no

It has further been argued that the petitioner is having clean antecedent, which fact has been stated in paragraph-3 of the petition. Considering the nature of accusation as well as the fact that the petitioner is having clean antecedent , let petitioner, namely, Atul Singha @ Atul Singh, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Pothia P.S. Case no.218 of 2015( G.R. No.1504 of 2015) with condition that the petitioner shall render full co-operation to the Investigating Officer.
