JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 Petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 278 of 2003 registered for the offences punishable under Section 395 of the Indian Penal Code and Section 27 of the Arms Act.

The case is based on the complaint petition and there is allegation of committing dacoity and petitioner is named in the FIR and case is of the year 2003 and impugned order shows that non-bailable warrant has been issued against the petitioner on 28.10.2011 and despite the same he failed to appear in court. Submission of learned counsel for the petitioner is that he has falsely been implicated and he was residing at Maharashtra and he has no knowledge about the case. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.1566 of 2019(2) dt.23-01-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this Cou9rt. With the above observation, this application is dismissed.
