2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 137(2) and 96 of the B.N.S.
3. The case of prosecution, in short, is that, the petitioner is alleged to have kidnapped the minor daughter of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that during course of the investigation the statement of the victim girl was recorded under Section 180 and 183 of B.N.S.S., wherein she has stated that she had gone with the petitioner on motorcycle to Ram Rekha Ghat
Patna High Court CR. MISC. No.62428 of 2025(4) dt.28-11-2025 2/2 where they were about to solemnized marriage, in the meanwhile, the police apprehended them. It has further been submitted that the petitioner has clean criminal antecedent as stated in para 3 of the bail petition. Moreover, the petitioner is languishing in judicial custody since 07.06.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ayer P.S. Case No. 53 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th District and Additional Sessions Judge-cum-Exclusive Special Court of POCSO Act, Bhojpur at Ara/concerned Court below.
