This application has been filed on behalf of the petitioners for modification of the order dated 18.07.2019 passed in Criminal Misc. No.44162 of 2019 with regard to extend the period of surrender of the petitioners, above named, in the court below. Learned counsel for the petitioners submits that vide order dated 18.07.2019 passed in Criminal Misc. No.44162 of 2019 by this Court, both the petitioners, above named, along with Md. Muntajeer and Bibi Chhedni were allowed the privilege of pre-arrest bail, in the event of surrender/arrest, within a period of four weeks from the date of the aforesaid order, in connection with Chausa P.S. Case No.173 of 2018, on furnishing bail bond of Rs.10,000/-(rupees ten thousand)

Patna High Court CR. MISC. No.57570 of 2019(2) dt.16-10-2019 2/2 each with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Udakishunganj, Madhepura, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code but, unfortunately, both the petitioners, above named, could not surrender before the court below within the time, as granted by this Court vide order dated 18.07.2019 passed in Criminal Misc. No.44162 of 2019.

In that view of the matter, learned counsel for the petitioners prays for extension of the period of surrender of the petitioners, above named, before the court below. Accordingly, let the period of surrender of the petitioners, above named, in the concerned court below in connection with the concerned case be further extended for a further period of six weeks from today.

With the aforesaid modification in the order dated 18.07.2019 passed in Criminal Misc. No.44162 of 2019 by this Court, this application stands disposed of.
