2. Petitioner seeks bail, who is in custody since 23.11.2023, in connection with Sessions Trial No. 109 of 2024 arising out of Buxar (Industrial) P.S. Case No. 306 of 2023, F.I.R. dated 19.11.2023 registered for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.

3. Allegation against the petitioner is that he has committed the murder of his wife as well as his younger daughter aged about 5 years with sharp cutting weapon.

4. Earlier the bail petition of the petitioner was

Patna High Court CR. MISC. No.61731 of 2025(3) dt.15-11-2025 2/3 rejected vide order dated 03.12.2024 in Cr. Misc. No. 72008 of 2024 and thereafter the petitioner has again moved before this Hon'ble Court in Cr. Misc. No. 47014 of 2025 and the same was rejected vide order dated 11.07.2025.

5. Learned counsel for the petitioner submits that the petitioner is in custody since 23.11.2023 and the trial is not in progress.

6. Learned APP for the State, on the other hand, vehemently opposed the prayer for bail and submits that the petitioner has committed the murder of his wife as well as his daughter who was only 05 (five) years old.

7. Vide order dated 18.09.2025 a report was called for with regard to the stage of the trial. Report dated 27.09.2025 of the learned Trial Court reveals that out of ten chargesheeted witnesses, six witnesses have already been examined. It appears from the report of the learned trial court that the trial is going on.

8. Considering the nature of allegation in the F.I.R. as well as in view of the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 109 of 2024 arising out of Buxar (Industrial) P.S Case No. 306 of 2023 pending in the Court of learned ADJ-

9. Prayer is refused.
