The petitioner being the uncle of the husband of the victim is apprehending his arrest in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code. The accusation is of killing the sister of the informant for non-fulfillment of dowry demands.

Learned counsel for the petitioner submits that the accusation is omnibus and general against the entire family members. The petitioner claims to be separate from the husband of the victim since last 25 years. Admittedly there is no eye witness to the occurrence though the Postmortem report reflects the cause of death due to asphyxia caused by hanging.

Considering the thrust of accusation against the husband of the victim, who is in custody, let the petitioner, abovenamed, in

Patna High Court Cr.Misc. No.25630 of 2016 (2) dt.28-06-2016 the event of his arrest or surrender before the court below within a period of twelve weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Lakhisarai, in Halso P.S.Case No. 16/2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
