JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 Petitioner apprehends her arrest in connection with Gardanibagh P.S. Case No. 310 of 2018 registered for the offences punishable under Sections 498A, 302 and 120B/34 of the Indian Penal Code.

Allegation against the accused persons, including the petitioner is of causing death of sister of the informant. Submission of learned counsel for the petitioner is that petitioner has relationship with husband of deceased and due to that petitioner had threatened to kill her and except that there is nothing against the petitioner.

Heard learned APP and learned Sr.Counsel for the informant, who has opposed the prayer for anticipatory bail. Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest

Patna High Court Cr.Misc. No.78873 of 2018(2) dt.11-01-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District JudgeIV, Patna, in connection with Sessions Trial No. 707 of 2018, arising out of Gardanibagh P.S. Case No. 310 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to cooperate in investigation, otherwise her bail bond shall be cancelled.
