The petitioner seeks bail in a case registered for offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the first information report was lodged against unknown. The petitioner has subsequently, i.e., after about five days, been implicated in the case only on the basis of suspicion that he has killed his minor daughter.

It is submitted that there is neither any eye witness nor is any substantial evidence or any other material which indicates towards the involvement of the petitioner's complicity in the

Learned counsel for the State has submitted that in paragraph nos. 21, 22 and 23 some of the witnesses have said that there was love affair between the petitioner's daughter and some person of the village and angered by that the petitioner might have killed his own daughter. However, at the same time he admits that the statement is on the basis of hearsay and suspicion as there is no eye witness etc. of the incident. Having regards to the facts and circumstances of the case, the petitioner, namely, Parmod Yadav is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Ranjan Raman, Judicial Magistrate, Begusarai in Bhagwanpur P.S.
