JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-09-2015 Heard learned counsels for the petitioner and the South Bihar Power Distribution Company Limited.

The petitioner is apprehending arrest in a case registered for the offences punishable under section 135 of the Electricity Act.

The accusation is of unauthorized consumption of electric energy. The loss has been calculated to the tune of Rs.32878/-.

It is submitted by learned counsel for the petitioner that there are two meters in the same holding and the petitioner being 70 years old lady was not aware about the illegality committed by the FIR named accused persons. The petitioner is not named in the FIR. However, the petitioner undertakes to deposit 50% of the loss calculated amount before the electricity authorities.

No.36206 of 2015 (2) dt.10-09-2015 2/2 On deposit of the aforesaid amount, let she be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, West Champaran at Bettiah in connection with Shikarpur P.S. Case No.430 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bond of the petitioner will be accepted on submission of substantial proof with regard to deposit of 50% of the loss calculated amount.
