JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-04-2023 At the outset, learned counsel for the petitioners submits that petitioners no. 1 (Rajdeo Yadav), 2 (Bhuneshwar Yadav) and 5 (Rameshwar Yadav @ Ramesher Yadav) have been arrested and as such, he seeks permission to withdraw this petition, so far as aforesaid petitioners are concerned. Accordingly, in respect of petitioners no. 1, 2 and 5, this anticipatory petition is dismissed as withdrawn. Now, with respect to prayer for anticipatory bail of
Patna High Court CR. MISC. No.61748 of 2022(2) dt.11-04-2023 2/3 rest petitioners i.e. petitioners no. 3 and 4, they apprehend their arrest in a case registered for the offence under Sections 307, 379, 504 & other allied sections of the Indian Penal Code. It is alleged that all the F.I.R. named accused persons, including these petitioners brutally assaulted informant and his family members, on account of which, four persons sustained injury.
It is submitted that petitioners i.e. petitioner no. 3 & 4 are ladies and there is no specific allegation of commission of assault against them. There is general and omnibus allegation. These two petitioners are only alleged to have snatched cash and jewellery. Petitioners claim clean antecedent. Learned A.P.P. for the State has opposed the bail petition.
Considering the general and omnibus nature of allegation and clean antecedent of petitioners, let the petitioner no. 3 and 4 namely Saroj Devi and Minni Devi @ Minta Devi, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Gaya in connection with Belaganj P.S. Case No. 69 of 2022, subject to
Patna High Court CR. MISC. No.61748 of 2022(2) dt.11-04-2023 3/3 condition as laid down under Section 438(2) of the Code of Criminal Procedure.
