In the light of order dated 18.04.2023, counter affidavit has been filed and Investigating Officer of this case, namely, Srikant Kumar, S.I. is present before the Court and his personal appearance is exonerated.

WJC No.1365 of 2022(5) dt.10-05-2023 2/2 It has been submitted by learned counsel for the petitioner that the grievances of the petitioner has been settled by virtue of the statement made in the counter affidavit and necessary correction has also been made in the order which is Annexure in the present counter affidavit. Learned counsel for the petitioner is agreed after going through the counter affidavit and the necessary correction has been made in the judicial order of the S.D.M. Patna Sadar.

In this background, the present Cr. Writ Application is hereby disposed off with a warning to the Investigating Officer that such mistake may not be caused in future and if cause, it must be rectified on its own level.
