The petitioners seek anticipatory bail in connection with Araria P.S.Case No. 490 of 2018, registered for offences punishable under Sections 120B, 323, 147, 149, 324, 354B, 379, 307, 504 and 506 of the Indian Penal Code. As per F.I.R., allegation against the petitioners is that all the F.I.R. named petitioners armed with deadly weapons came and assaulted the informant with other persons and they
Patna High Court Cr.Misc. No.887 of 2019(3) dt.31-01-2019 2/2 tried to outrage modesty to the wife of the informant. Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case at the instance of their enemies and there is a case and counter case in between the parties. It is also submitted that the petitioners have no criminal antecedents.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Araria P.S. Case No. 490 of 2018, to the satisfaction of learned Chief Judicial Magistrate, Araria, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
