The petitioners herein seek anticipatory bail in Barsoi P.S. Case No. 59 of 2016 registered under Sections 147, 148, 149, 341, 323, 379 and 506 of the Indian Penal Code. The petitioner no. 1 is maternal uncle of the informant. The allegation is of assault and committing theft of some articles against the petitioners. This happened on the eve of Holi. There is a counter version of the occurrence lodged by petitioner no. 1 in which he has also stated to have received injury. The injury sustained by the informant is although on head but simple in nature.

No.25992 of 2016 (3) dt.12-07-2016 Considering the particular facts of the case, I am inclined to extend the privilege of anticipatory bail, let the petitioners above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned C.J.M. Katihar, DistrictKatihar in Barsoi (Sudhani o.p) P.S. Case No. 59 of 2016 subject to the condition as laid down under Section 438(2), the code of Criminal Procedure with further condition that one of the bailors shall be his/their own/close family member. The petitioners shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel their bail bonds.
