For the Petitioner/s :

Mr.Arvind Kumar Singh For the Opposite Party/s :

Mr.Vinod Shankar Modi ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 Petitioner apprehends his arrest in connection with Barachatti P.S. Case No. 47 of 2017 registered for the offences punishable under Sections 18, 20 and 22 of N.D.P.S. Act. Allegation against the petitioner is of cultivating opium and police seized the same, which will appear from seizure list.

Submission of learned counsel for the petitioner is that the land does not belong to the petitioner and he has falsely been implicated on the basis of disclosure made by villagers. Heard learned APP also.

Having heard both sides and in view of allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which will be considered on its own merit, without

Patna High Court Cr.Misc. No.78870 of 2018(2) dt.11-01-2019 2/2 being prejudiced by this order.

With the above observation, this application is dismissed.
