The petitioner apprehends his arrest in Aurangabad Town P.S. Case No. 84 of 2011 for the offences committed by the petitioner under Sections 406, 420, 467, 468 and 120B of the Indian Penal Code.
The informant filed complaint on the basis of which the first information report was registered. The informant named the petitioner along with other accused persons and made allegation against accused no. 1, Ranjan Kumar Singh, and accused no. 2, Varun Singh. It is submitted that the informant himself was an agent of O.C.P.L. Company and he collected the premium from different persons, but, did not deposit the same in the Company. The informant has not produced any cheat of paper to show the deposit of the amount in the Company. The petitioner is the Regional Manager of the Company and the informant did not make any specific allegation against the petitioner. It is, further, submitted that the petitioner was also made an accused in Aurangabad Town P.S. Case No. 80 of 2011 and he has already been granted anticipatory bail vide order, dated 17.10.2017,
Patna High Court Cr.Misc. No.47690 of 2017 (4) dt.13-11-2017 2/2 passed in Cr. Misc. No. 46197 of 2017. On the same and similar allegation the present case has been filed.
Considering the facts, aforesaid, the petitioner, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Aurangabad Town P.S. Case No. 84 of 2011 to the satisfaction of Chief Judicial Magistrate, Aurangabad, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
