The petitioner apprehends his arrest in a case registered under section 380 and other allied sections of the Indian Penal Code and Section 27 of the Arms Act. The allegation against the petitioner is that he had fired which hit on the left side of the chest of the informant. The doctor found multiple injury caused by fire arm. It is submitted that on account of land dispute, earlier a proceeding under section 144 Cr.P.C. was initiated but the rule was made absolute in favour of the petitioner. The doctor opined the injury to be simple in nature.
In view of the fact that there is allegation of firing against the petitioner which hit on the chest of the informant, I am not inclined to grant anticipatory bail to the
Patna High Court Cr.Misc. No.43122 of 2014 (3) dt.09-04-2015 petitioner in connection with Bidupur P.S. Case No. 301/2013 pending in the court of the Chief Judicial Magistrate, Vaishali at Hajipur. This application is, accordingly, rejected. (Prabhat Kumar Jha, J) Amin/- U
