JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Section 387/34 of the Indian Penal Code, Section 27 of the Arms Act and 3/4 of the Explosive Substance Act.

Petitioners are not named in the first information report but it would appear from perusal of paragraph-21 of the supplementary case diary that petitioner no.1 was arrested in connection with Darpa P.S. Case No.96 2015 and, subsequently, he was remanded in the present case. The aforesaid petitioner no.1 confessed his guilt disclosing the name of petitioner no.2 as well

Patna High Court Cr.Misc. No.28202 of 2016 (3) dt.27-09-2016 2/2 as others. The investigation against the petitioners has already been completed and it appears that except the aforesaid confessional statement and criminal antecedent of petitioner no.1, there appears to be nothing against these petitioners. Moreover, co-accused Phool Mohammad and Ranjan Kumar Yadav having more or less similar allegation, have already been granted privilege of bail by a Co-ordinate Bench of this Court. Accordingly, petitioners above named are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Raxaul, East Champaran at Motihari in connection with Chhauradano P.S. Case No.193 of 2015.
