The petitioner seeks anticipatory bail in connection with Agamkuan P.S. Case No. 99 of 2017, registered for offences punishable under Sections 419, 420, 467, 468, 471 and 120 (B) of the Indian Penal Code.
As per F.I.R., allegation against the petitioner is that the elder brother of the informant constituted a firm and appointed his wife as proprietor of the said firm and in collusion with the petitioner, Branch Manager, Punjab National Bank, took cash credit of Re. 1 crore 30 lacs in the year 2015 by mortgaging a joint house of the informant and his brother. As such, from allegation it appears that there is dispute between two brothers.
Patna High Court Cr.Misc. No.78378 of 2018(2) dt.08-01-2019 2/3 Submission of the learned counsel for the petitioner is that the petitioner is innocent and has not committed any offence and she was Branch Manager of Punjab National Bank at the relevant time and recommended for sanction of loan. It is further submitted that the accused persons namely, Jay Shankar and his wife Sunita Devi have already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 20.09.2018, passed in Cr. Misc. No. 57141 of 2018 and other accused persons have also been granted bail by different Co-ordinate Benches of this Court and the petitioner has no criminal antecedent.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of her arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Agamkuan P.S.Case No. 99 of 2017 to the satisfaction of learned A.C.J.M., Patna City, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. and also considering the fact that the petitioner is a Government employee and there is no chance of absconding and petitioner
