JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 414, 120(b) and 34 of the Indian Penal Code.

Neither the petitioner was caught on the spot nor anything was recovered from his conscious possession and according to prosecution case, three persons were caught on the spot and disclosed the name of the petitioner. Moreover, the alleged recovery was made from a Banana orchard, situated at the back of the house of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact

Patna High Court Cr.Misc. No.26108 of 2016 (2) dt.05-07-2016 2/2 that the petitioner does not have any criminal antecedent, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No. 673 of 2015.
