The petitioner apprehends his arrest in connection with Complaint Case No. 79C of 2017 instituted under Sections 420, 406 and 120B of the Indian Penal Code. . Allegation in brief is that complainant gave Rs. 51,000/- cash to the petitioner and Rs. 49,000/- deposited in the account of co-accused Saurabh Kumar on the promise of getting him appointed to the post of Urdu Teacher, but neither complainant got employment nor money was returned to him. Learned counsel for the petitioner submits that petitioner himself is a unemployed person and Saurabh Kumar is a teacher and there is no any material to show that any money in
Patna High Court Cr.Misc. No.52946 of 2017 (2) dt.10-11-2017 2/2 cash was given to the petitioner and he has got no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioner, namely, Kamlesh Kumar, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Juned Alam, Judicial Magistrate, 1st Class, Jamui in connection with Complaint Case No. 79C of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
