JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 Petitioner apprehends his arrest in connection with Mokama P.S. Case No. 246 of 2018 registered for the offences punishable under Sections 30(a) and 41(i) of Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 1240 litres of liquor from the house of one Piku Singh and also there was recovery of 20.625 litres of liquor from his house and petitioner is named in the FIR, who is alleged to have brought the liquor. It further appears that petitioner is accused in one more case of similar type.
Submission of learned counsel for the petitioner is that nothing has been recovered from his possession or from his house and earlier also nothing was recovered from his
Patna High Court Cr.Misc. No.1535 of 2019(2) dt.23-01-2019 2/2 possession, in which he is on bail.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender within a period of six weeks from the receipt of this order and pray for regular bail, which shall be disposed of on the same day, if possible, considering the submission of learned counsel for the petitioner. With the above observation, this application is disposed of.
