In this case, the petitioner is apprehending his arrest in connection with Chapra Muffasil P.S. Case No. 279 of 2018 registered for offences under sections 304(B) 201/34 of the Indian Penal Code.
As per allegation made in the First Information Report, the marriage of the victim girl was solemnized with one Chandan Mahto, on 11.7.2018 in the evening at 5 PM, the Informant received telephonic call of his daughter that the accused persons were assaulting her. On that information, when the Informant went there, he found her daughter died and all family members have fled away from there.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.260 of 2019(2) dt.11-01-2019 2/2 petitioner is a cousin father-in-law and the husband is in jail. He has further submitted that the petitioner is living separately to his brother and has no connection with him.
Looking to the entire facts and circumstances of the case, let the petitioner, namely, Lal Mohan Mahto @ Lal Mohar Mahto, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra at Saran in connection with Chapra Mufassil P.S. Case No. 279 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
