JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Petitioners apprehend their arrest in connection with Fulwaria P.S. Case No. 169 of 2018 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

Allegation against the petitioners is of kidnapping of minor daughter of the informant.

Submission of learned counsel for the petitioners is that statement of the girl has been recorded under Section 164 Cr.P.C. in which she has not supported the prosecution case. Heard learned APP also, who has opposed the prayer for anticipatory bail on the ground that the victim girl is minor. Having heard both sides and in the facts and

No.1023 of 2019(2) dt.16-01-2019 2/2 circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XIII, Gopalganj, in connection with Fulwaria P.S. Case No. 169 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
