JUSTICE SHIVAJI PANDEY ORAL ORDER 06-02-2019 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. In this case, the petitioner is seeking anticipatory bail in connection with Singhwara P.S. Case No. 125 of 2015 registered for offence punishable under sections 323, 341, 354(B), 307, 448, 427, 504/34 of the Indian Penal Code. The petitioner had moved earlier before this Court in Cr. Misc. No. 33785 of 2017 and this Court, vide order dated 31.07.2017, rejected the same with a liberty, if the petitioner surrenders before the court below within four weeks from today, the court below will pass order in accordance with law without being influenced by the order of this Court. The order has been passed on 31.07.2017 and still the petitioner has not surrendered himself before the court below.

No.79729 of 2018(2) dt.06-02-2019 2/2 The learned counsel for the petitioner submits that the parties have entered into compromise and filed their compromised petition, there is no chance of any conviction and similarly situated persons have already been granted bail. Looking to the fact the petitioner had earlier moved before this Court unsuccessfully, this Court is not inclined to grant him bail and accordingly his prayer for bail is dismissed. However, if the petitioner surrenders before the court below, the court below will consider the case, any compromise petition has been filed by the parties and pass an order in accordance with law, preferably on the same day.
