JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioners, learned counsel for the informant and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code.
Prosecution case is that for a petty dispute the accused persons assaulted the informant's side causing injuries.
It is submitted by the learned counsel for the petitioners that most of the injuries have been found simple in nature, though with regard to some of them opinion is reserved.
Patna High Court Cr.Misc. No.37729 of 2015 (3) dt.28-09-2015 There is counter version of the occurrence. Petitioners' sides have also received injuries. The accusation of assault is omnibus and general.
It is submitted by the learned counsel for the informant that three persons received injuries on the vital part of the body and opinion with regard to some of the injuries has been kept reserved.
Considering the nature of accusation and the fact that the petitioners' side have also received injuries, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri M.K. Srivastava, Judicial Magistrate, Ist Class, Siwan in connection with Bhagwanpur P.S. Case No. 46 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
