JUSTICE SANJAY PRIYA ORAL ORDER 30-11-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Kotwali P.S. Case No. 185 of 2017 instituted for the offence under Sections 406, 420, 504, 506 and 120(B) of the Indian Penal Code. There is allegation against the petitioner that he was broker in the deal of the land between the informant and the accused Nos. 1 and 2 of the complaint petition. Learned counsel for the petitioner has submitted that the petitioner has only helped the informant for purchasing the land. The informant has made the petitioner as accused due to annoyance because the vendor has not executed the sale deed with regard to land in question till date.

Case diary has been received in which the witnesses

Patna High Court Cr.Misc. No.53761 of 2017 (3) dt.30-11-2017 2/2 have supported the allegation against the petitioner. There is specific allegation that the petitioner acted as broker in the land deal between the informant and the landlord. The informant has paid an amount of Rs. 4 lacs to the petitioner out of Rs. 6 lac as his brokerage charge for aforesaid land deal. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected. The petitioner is directed to surrender in the court below and seek regular bail which will be considered by the court below and disposed off in accordance with law without being prejudiced by this order preferably on the same day.
