The petitioner is apprehending his arrest in a case registered for the offence punishable under sections 420/34 of the Indian Penal Code and 7 of the E.C.Act.
Prosecution case is that on the basis of secret information a raid was conducted and from the two houses 125 bags of rice and 76 bags of wheat suspected to be of Government scheme were seized. The wife of owner of the houses disclosed that the said foodgrains belong to the petitioner.
It is submitted by the learned counsel for the petitioner that nothing was recovered from the possession of the petitioner nor from his P.D.S. shop. The petitioner has been roped in this case merely on suspicion.
Considering the fact that the recovery has not been made
Patna High Court Cr.Misc. No.25184 of 2016 (2) dt.21-06-2016 from the possession of the petitioner, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within a period of twelve weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Angarh P.S. Case No. 5/2016, G.R.No. 312/2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Surendra/- U
