The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406, 468, 471, 120B of the Indian Penal Code. The prosecution case is that the petitioner received Rs. 30 lakh in cash from the informant on assurance to transfer some land near the mental hospital at Koilwar, Ara, but neither land was transferred nor money was returned to the informant.
On the joint prayer of both the parties, the
Patna High Court Cr.Misc. No.34387 of 2015 (3) dt.04-11-2015 matter was referred to the Mediation and Conciliation Centre of the State Legal Services Authority. The report of the Mediator dated 05.10.2015 reflects that the issue could not be resolved through the process of mediation. It is submitted by the learned counsel for the petitioner that it appears unreasonable to Rs.30 lakhs was given in cash without any documentation, nor the agreement was made between the parties. The present case has been lodged maliciously since the petitioner was on litigating terms with the brother of the informant namely Lalan Kumar, who lodged three complaint case against the petitioner. Learned counsel for the informant submits that though there is no documentary proof with regard to demand, but the petitioner handed over the original deed of the land in question.
Considering the nature of accusation and on particularly the mode of transfer of such huge cash without any documentation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 708 of 2013, subject to conditions as laid down under
