2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 461 , 379 and 511 of the I. P . C .

3. As per the prosecution case, on 20.05.2023 , at about 2:30-3:00 PM some unknown miscreants damaged the PNB ATM machine at Sandalpur, Munger by gas cutter to commit theft of money but they did not succeed to cut the machine . It is further alleged that in CCTV footage the incident was captured.

4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and he is innocent and has falsely been implicated in this case only on the basis of

5. Learned counsel for the State opposes the prayer for bail and submits that his name was disclosed by the other coaccused person namely Priyesh Kumar who was apprehended and confessed that this petitioner was also indulged in this occurrence with him. It is further submitted that the motorcycle which was used in the commission of the occurrence was seized in front of the house of the petitioner.

6. Considering the nature of accusation and gravity of allegation, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
