The petitioner seeks anticipatory bail in connection with Begusarai Mufassil (Singhoul) P.S.Case No. 309 of 2016, registered for offences punishable under Sections 341, 323, 448, 504, 307/34 of the Indian Penal Code and under Section 27 of Arms Act.
As per F.I.R., allegation against the petitioner is that he along with others came to his house and started abusing and assaulting the informant and the petitioner fired at his pistol with intention to kill the informant due to the reason behind the occurrence is that wife of the informant Sintu Kumari has illicit relation with the petitioner.
Submission of the learned counsel for the petitioner
Patna High Court Cr.Misc. No.270 of 2019(3) dt.31-01-2019 2/2 is that he has not committed any offence and the petitioner has falsely been implicated in this case and no FIR itself shows that the firing by the petitioner did not hit any body and he has no criminal antecedent.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Begusarai Mufassil (Singhoul) P.S.Case No. 309 of 2016, to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
