ANJANA MISHRA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. Learned counsel for the informant is also present.

The petitioners are apprehending their arrest in connection with Forbesganj P.S. Case No.170 of 2016 for allegedly having committed the offences under Sections 341, 323, 384, 379, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that there is a case and counter case between the parties with regard to the same occurrence of auction of cattle in the auction held in the Customs Office. The F.I.Rs. lodged by both the parties are virtually identical, save and except the amounts involved in the

Learned counsel for the petitioners submits that apparently, it is a case of rivalry between the two parties which has resulted in the lodging of the present case. The petitioners have also filed a similar case against the informant. Having heard learned counsel for the petitioners and the learned counsel for the informant, it appears that there was some rivalry existed between the parties, which has led to filing of the present case.

In view of the aforementioned facts and circumstances and also that the present petitioners have no criminal antecedents, let all the three petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No.170 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
