JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2019 The petitioners apprehend their arrest in connection with Sahebganj P.S.Case No. 289 of 2018 registered under Sections 323,363,364,365,366A and 504 of the Indian penal Code. Allegation as per complaint petition on the basis of which FIR has been lodged is that son of the petitioner no. 1 induced away the daughter of the informant with a purpose to marry her and when he along with others went to them about the same, they threatened him due to which they came back. Submission of learned counsel for the petitioners is that petitioners are father, brother and mother of the main accused Rajendra Mukhiya as per complaint petition and they have been falsely implicated and the falsity of the case will appear from

Patna High Court CR. MISC. No.79511 of 2018(5) dt.03-04-2019 2/2 the fact that complaint petition has been lodged after delay of four months of the occurrence though in her statement recorded Section 164 Cr.PC. victim girl stated that she was kept in the house of the petitioners.

Heard learned APP also who has opposed the prayer for anticipatory bail on the ground that there is statement of the girl under Sections 161 and 164 Cr.P.C.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-1st, Muzaffarpur(West) in connection with Sahebganj P.S. Case No. 289 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
