ANJANA MISHRA ORAL ORDER 07-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Learned counsel for the opposite party is absent.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 498(A) /34 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that on earlier occasions, the Court while hearing this matter had directed the petitioner to withdraw the complaint filed by him as against the opposite party no. 2 Laxmi Devi. Today, a copy of the application filed by the petitioner seeking withdrawal of the case filed by him

Patna High Court Cr.Misc. No.44443 of 2014 (6) dt.07-09-2015 as against Laxmi Devi has been produced. The said petition dated 24.06.2015 states that since the matter has been amicably settled between the parties, he is withdrawing the complaint filed against opposite party no. 2 Laxmi Devi and Ors.

Keeping in view, the bonafide act of the petitioner and also the submission that he is willing and ready to keep the opposite party no. 2 with all honour and dignity, let the petitioner Sanjay Sah, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate (East), Muzaffarpur in connection with C. No. 1854/12, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
