2. The petitioner is in custody since 25.04.2016 in connection with Salkhua P.S. Case No. 69 of 2016 for the alleged offences under Section 273 of the Indian Penal Code and Section 47(g) of the Bihar Excise Act, 2016.

3. It is submitted that the petitioner has been falsely implicated as he merely happens to be the driver of the tempo. The passenger of the tempo Ramchandra Choudhary has been granted bail by this Court in Cr. Misc. No. 25436 of 2016.

4. Considering the quantity of recovery being 15 packets of country made wine each packet containing 20 pieces of 400 ml. and that the petitioner was the driver of the tempo, this Court is not inclined to grant privilege of bail to the petitioner. The bail petition stands dismissed.
