JUSTICE ARUN KUMAR ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Rajoun P.S. Case No.171 of 2017, registered under Sections 341, 323, 308, 504 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner runs a private school and the informant of this case was digging out the earth near the boundary wall of the school where an electric poll was installed when the petitioner objected thereafter the accused persons were assaulted by the informant for that the petitioner filed a police case, so there is case and counter case and the sole injury found on the person of the informant is simple in nature and the petitioner has got no criminal antecedent.

No.52899 of 2017 (2) dt.09-11-2017 2 /2 Having considered the said facts and circumstances, let petitioner, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bank in connection with Rajoun P.S. Case No.171 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
