2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 317(4), 317(5), 3(5) of the Bharatiya Nyaya Sanhita.

3. Prosecution case, in brief, is that on the alleged date and time, during patrolling, co-accused Aashish Kumar was caught with a motorcycle without number plate and proper documents. During investigation, it has come that the said motorcycle was purchased from this petitioner in Rs. 6,500/- without valid papers.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. No incriminating material has been recovered from conscious

Patna High Court CR. MISC. No.64497 of 2025(2) dt.16-09-2025 2/2 possession of the petitioner and he has been made accused in this case merely on the basis of confessional statement of coaccused who was apprehended on the spot. Petitioner has got no criminal antecedent of similar nature.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Rajapakar P. S. Case No. 37 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
