JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-272, 273 of the Indian Penal Code and under Section47(A) of the Excise Act. In huge quantity, country-made Mahua liquor was recovered from a vehicle and the informant claims to identify the petitioner and one co-accused, Bharat Chaudhary while they were fleeing from the place of occurrence. Co-accused, Bharat Choudhary has already been granted privilege of bail by learned Additional Sessions Judge-IVth, Sasaram but the prayer for bail of the petitioner was rejected by learned IIIrd Additional Sessions

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that nothing has been recovered from conscious possession of the petitioner nor the vehicle in question belongs to the petitiioner, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sasaram Tilouthu P.S. Case No. 925 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram. (Hemant Kumar Srivastava, J) A.K.V./- U T
