The petitioners apprehend their arrest in Main P.S. case No. 13/2016 under Section 304B, 201/34 of the Indian Penal Code.
The informant alleged that his daughter was married to Subodh Yadav, son of petitioners No.1 and 2, five years ago and her Duragman was performed in the last year. When the daughter of informant went to her Sasural the accused persons demanded a ring and for that they were torturing the daughter of informant. On 01.04.2016 the informant got information that his daughter was killed and her dead body was disposed of. It is submitted that petitioners are mother-in-law, father-in-law and maternal grand father of the deceased. No specific allegation is made against the petitioners.
Patna High Court Cr.Misc. No.26307 of 2016 (3) dt.20-08-2016 2/2 The learned counsel for the informant as well as the learned Additional Public Prosecutor, however, opposed the prayer for anticipatory bail.
It appears that the marriage was performed five years ago but the informant or the deceased never made any complaint about the ill treatment at the hands of her in-laws. The case of the petitioners is that they have no manner of concern with the family affairs of deceased and her husband.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateVI, Gaya in Main P.S. Case No. 13 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
