Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 341, 353, 504, 506, 34 of the Indian Penal Code. It is alleged by the Executive Engineer, Water Resources Department, Chapra that the petitioners being Class IV employees of the department used to misbehave with the employees and officers by using filthy languages in intoxicating condition.
It is submitted by learned counsel for the petitioners that petitioner No. 2 filed Complaint Case No. 3188 of 2013 under the provisions of the SC/ST Act on 05.10.2013
Patna High Court Cr.Misc. No.46785 of 2014 (2) dt.24-04-2015 2/2 and thereafter the present case has been lodged as retaliatory measure.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 197 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
