JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 The petitioner apprehends his arrest in connection with Complaint Case NO. C-820/16 registered under Sections 498A of the Indian penal Code and Sections 3 and 4 of the Dowry Prohibition Act.
Allegation against the petitioner is of torturing his wife with respect to demand of Rs. 2 lacs.
Submission of learned counsel for the petitioner is that he is ready to compromise the case with the O.P. No. 2 and is also ready to keep her.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,
Patna High Court Cr.Misc. No.1475 of 2019(2) dt.23-01-2019 2/2 be surrendered before the court below within a period of six weeks from the date of receipt of a copy of this order, and the court below shall release him on provisional bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) to its own satisfaction for a period of three months. In the meantime, after issuance of notice to the O.P. No. 2, the court below will try to make reconcilliation between the parties and if it is found that petitioner is ready to keep his wife, provisional bail granted to the petitioner be confirmed, otherwise court below is free to pass any other appropriate order; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
