JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 498A/341/323/307/34 of the Indian Penal Code.

The basic accusation is of torture for non-fulfillment of dowry demand and tried to strangulate the informant. Learned counsel for the petitioner submits that the petitioner denies the factum of marriage. The informant has lodged altogether six cases against the petitioner out of which the petitioner has been granted anticipatory bail in Dehri P.S. Case No. 266 of 2010 on 28.05.2015, filed levelling accusation under section 498A IPC wherein the petitioner has been directed to pay Rs.750/- per month to the informant opposite party no.2. Consequently, the petitioner is making the payment.

No.34909 of 2015 (2) dt.24-08-2015 2/2 Considering the factum of marriage in dispute, the informant has filed several cases with similar accusation and in one of the cases the petitioner has been granted anticipatory bail and making payment of Rs.750/- per month to the informant, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Shastrinagar P.S. Case No.717 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
