The petitioner apprehends his arrest in connection with Raxaul P. S. Case No. 90 of 2016 instituted under Sections 302, 201, 420 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that complainant's son died due to tractor accident and the same is mentioned in the complaint itself. He submits that said date of occurrence is of 11.01.2016 but the complaint was lodged on 28.04.2016 without giving any cogent reason and this petitioner has got no criminal antecedent and a title suit is also going on between the parties.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.53053 of 2017 (2) dt.09-11-2017 2/2 circumstances, let the petitioner, namely, Vakil Yadav @ Vokil Yadav @ Wakil Yadav, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Raxaul at Motihari in connection with Raxaul P.S.Case No. 90 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
