JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 This application, for grant of anticipatory bail, arises out of Akbarpur P.S. Case No. 200 of 2018, disclosing offences under Sections 147, 148, 149, 307 of the Indian Penal Code and section 27 of the Arms Act.

Allegation as per F.I.R. is that several accused persons intercepted the son of informant and co-accused Gopal Singh opened fired on the son of informant causing injury to him. It is further alleged that while accused persons fleeing away, the petitioner exploded bomb.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no injury caused by bomb has been found on the person of the son of the informant rather fire arm injury has been found on his person.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Akbarpur P.S. Case No. 200 of 2018 , subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
