2. The petitioner apprehends his arrest in connection with Mahila (Lakhisarai) P.S Case No. 30 of 2024 for the offence registered under sections 498A, 494, 341, 323, 504, 506/34 of the IPC and Section 3/4 of Dowry Prohibition Act lodged on 16.04.2024 by the informant, Sita Devi.

3. As per the prosecution story, the informant alleged that she was married to the petitioner in the year 2019 but was always tortured for the dowry. In the year 2022, the panchayati was held but he continued with his beating attitude and lastly was thrown out from the house. This led to the FIR.

4. Learned counsel for the petitioner submits that he wants to keep his wife with full dignity and honour but she on the other hand, has left the home. He has also sent her a legal notice in the year 2020 and in any case, want to take care of her by paying Rs.6000 per month to be deposited in her account by 10th of every month.

5. Learned counsel for the informant submits that the petitioner has gone for re-marriage.

6. Learned counsel for the petitioner disputes the same.

7. Considering the submissions of the parties, the case is there, the petitioner will be facing the trial and an undertaking has been given to pay Rs. 6,000/- per month to the lady by 10th of every month, in that background, this Court is inclined to grant him the anticipatory bail with conditions.

8. However, if the petitioner fails to make the payment by 10th of every month, the lady shall be free to take steps for cancellation of his bail bond.

9. Let the petitioners in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the

No.63171 of 2025(3) dt.10-12-2025 3/3 like amount each to the satisfaction of the learned C.J.M, Lakhisarai in connection with Mahila (Lakhisarai) P.S Case No. 30 of 2024, subject to the following conditions. (i) one of the bailor should be the family members/relatives of the petitioner, who shall provide official document to show his bona fide.

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the trial court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds.

(iv) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to take steps for cancellation of the bail bonds. (Rajiv Roy, J) vashudha/- U T
