JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This is an application for grant of anticipatory bail in connection with Turkauliya (Banjariya) P.S. Case No. 457 of 2019, disclosing offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

On information that petitioner has kept liquor in the house of one Santosh Singh, police raided the house of Santosh Singh and recovered 110.265 liters of foreign liquor of different quality and as such, petitioner and Santosh Singh have been named in the F.I.R.

Submission of the learned counsel for the petitioner is that except confidential information, there is nothing against the petitioner and there is no source of information. He has no criminal antecedent.

Patna High Court CR. MISC. No.59698 of 2019(2) dt.23-09-2019 2/2 Heard learned A.P.P. also who has opposed the prayer for bail of the petitioner.

Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of the materials available in the case diary, especially, in the light of above submission and considering the same, the learned Special Judge shall dispose of the prayer for bail of the petitioner, if possible on the same day.
