Petitioner is apprehending his arrest in connection with Paharpur P.S.Case No.160 of 2019 , registered for offences punishable under Sections 341, 323, 324, 307, 506, 504/34 of the Indian Penal Code.
Allegation against the petitioner is of assault by Farsa on the head of the father of the informant.
Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted and injury of Hari Lal Sah, father of the informant, is found to be caused by hard and blunt substance, whereas there is allegation that when Hari Lal Sah fall down, other accused persons assaulted him by Lathi.
Patna High Court CR. MISC. No.57742 of 2019(2) dt.13-09-2019 2/2 Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail on the ground that the injuries are grievous in nature.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran in connection with Paharpur P.S.Case No.160 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
