ANJANA MISHRA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The present Modification Application, has been filed by the petitioner for extension of time as was fixed in order dated 18.05.2016. Learned counsel for the petitioners submits that the amount of Rs. 5,00,000/- could not be arranged and on account of the same the petitioners could not comply with the order passed by this court. However, the petitioners submit that the said amount shall be deposited within a period of six weeks from the date of passing of this order. He submits that non-compliance of the earlier order was on account of certain unavoidable circumstances but now the petitioners has arranged to deposit the same. Having heard learned counsel for the petitioners, this
Patna High Court Cr.Misc. No.27184 of 2016 (2) dt.17-08-2016 2/2 court is satisfied with the ground made out in the Modification Application. Let the time fixed in order dated 18.05.2016 be read as to run as six weeks from today within which period the petitioner shall deposit the amount. In case of failure by the petitioner to deposit the amount as stated in the present application, i.e within the period of six weeks, the order dated 18.05.2016 shall automatically be deemed to have been withdrawn.
